These Terms and Conditions specifically cover our Website and online trading.

The Company asks that you, The Buyer, pay particular attention to the following sections as these may differ to other online website terms, due to the value of The Goods and risk of damage and theft that some of The Companies metal products invite.

1. General
1.1 The Company reserves the right to change its Terms and Conditions for this website at any time including the ‘changing of’, ‘modification of’ and/or ‘removal of’ any of its content without notice.
1.2 It is The Buyers’ responsibility to make sure that they have read and fully understand these Terms and Conditions prior to making purchases.
1.3 All headings used are used for ease of use.

2. Copyright
2.1 The Company is granted copyright protected under UK copyright law. By using this website The Buyer agrees not to copy or misappropriate any content without The Companies express permission. The Company refers specifically to written text (articles, product descriptions, blog posts, and FAQs; Images and photographs (including product shots, banners, logos, and infographics), graphics and illustrations, videos and audio files, logos, branding, and visual designs
Copying or using these materials without permission (even unintentionally), will be an infringement of The Companies rights.
2.2 Credit will be given if content [as outlined above] is sourced by another creator.
2.3 Brand logos used to showcase products not manufactured by The Company are the copyrighted property of their original creator.
2.4 The brand logo ‘Code Red Products’ is a trading name of The Company - trademarked under the UK trademark number UK00003801339..

3.1 Membership is available to customers on The Companies website.
3.2 Charges are correct in line with the publication of these terms.

6. Price
6.1 The Company reserves the right to change advertised rates published on this website at any time including the ‘changing of price’, ‘modification of listed items’ and/or ‘removal of listed items’.
6.2 Unless otherwise stated, advertised metal prices are valid for 24 hours OR until stocks are depleted, whichever comes first.
6.3 Metal prices are based upon the London Metal Exchange (LME) and currency exchange rates, both of which will fluctuate, effecting the sale price. The Company reserves the right to refuse orders for metal products once stocks are depleted. The holding of any advertised rate will be at The Companies discretion and its decision is final.
6.4 Rolled metal prices are priced per roll and sold by theoretical weight - actual weights may differ by the tolerances as set out within the relevant metric manufacturing standards.
6.5 Set percentage discount codes are only valid during the offers advertised ‘time period’ and only relate to available stock. Personalised membership offers may not be shared across users.
6.6 All rates are net of VAT which will be added at the checkout.
7. Cancellation
7.1 Orders may only be cancelled if the orders have not been shipped.
7.1.1 A restocking charge of 25% will be levied against all Metal roll purchases inclusive of Lead, Copper and Stainless Steel [including Lead, copper and stainless steel rolls, lead expansion joints and slates].
7.1.2 A restocking charge of 15% will be levied against all other ancillary products.
7.2 The Company does not offer refunds for digital downloads.
8. Delivery
8.1 Unless otherwise agreed between The Parties, The Company (or its third-party agents) shall deliver the Goods to a delivery address notified to The Company by The Buyer.
8.2 Prior to dispatch, The Buyer must notify The Company of any restrictions that may impede delivery.
8.3 Any dates specified by The Company for delivery of the Goods are intended to be an estimate and time for delivery shall not be made of the essence by notice. If no dates are so specified, delivery shall be within a reasonable time of 1 to 4 working days.
8.4 Subject to the other provisions of these conditions The Company shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods.
8.5 In the case of palletised Goods, The Company’s (or its third party agents) are responsible for delivering to The Buyers designated location. The Company’s (or its third party agents) will assume that facilities including mechanical offload apparatus will be available to offload The Goods. The Buyer may request other offloading options such as a ‘tail-lift’ offload. It is important to note that these are only available upon request, they are not guaranteed and that these facilitate the unloading from the vehicle to the ground only.
8.6 If The Company’s vehicle (or its third-party agents) is kept on site for an unreasonable time or must return to the dispatchers’ premises without completing delivery through lack of assistance, delay in off-loading, access constraints, an additional charge will be made to cover the redelivery costs.
8.7 The Company does not undertake to deliver or collect any load on roads or ground which, in The Company’s discretion, is considered to be unsuitable. If a vehicle used for performing The Buyers’ delivery or collection from a place situated off the public highway, The Buyer is to be solely responsible for any damage or accident and is to fully indemnify The Company and its employee(s) in respect thereof.
8.8 In case of site deliveries, if for any reason The Buyer fails to accept delivery of any of the Goods when they are ready for delivery, or The Company is unable to deliver the Goods on time because The Buyer has not provided appropriate instructions, documents, licenses or authorisations:
8.8.1 risk in the Goods shall pass to The Buyer (including for loss or damage);
8.8.2 the Goods shall be deemed to have been delivered; and
8.8.3 The Company may store the Goods until delivery, whereupon The Buyer shall be liable for all related costs and expenses (including, without limitation, storage and insurance).
8.9 Unless otherwise expressly agreed in writing our prices only cover delivery and working on normal working days and during normal working hours. All deliveries made or work done at The Buyers request on Bank Holidays, Sunday and Saturday afternoons and outside normal working hours, will be subject to extra charges.
9. Receipt of Goods
9.1 The Buyer shall provide at the Delivery Point and at its expense adequate and appropriate equipment and/or manual labour appropriate for unloading or (in the case of collection of the Goods by The Buyer) loading of the Goods.
9.2 The Buyer shall, either themselves or by their duly authorised and appointed representative, sign the delivery ticket as acknowledgement of delivery provided that, on delivery to the address nominated by The Buyer, The Company shall be entitled to assume that any signature given is that of such representative.
9.3 The Goods will not be left without signature unless express instructions have been given in writing by The Buyer that will accept solely responsible for The Goods and is to fully indemnify The Company and its employee(s) (or its third-party agents) in respect of any loss therefor.
9.4 Deviations in quantity or damaged to The Goods, must be reported immediately by reporting in writing on the delivery documentation [where electronic or hard copy] and counter signed by The Company’s representative (or its third-party agents).
10. Reporting Damages
10.1 Reporting damage to The Goods, must be reported immediately by reporting in writing on the delivery documentation [where electronic or hard copy] and counter signed by The Company’s representative (or its third party agents).
10.1.1 Be as descriptive as possible and take pictures. These will assist to clarify The Buyers claim as well as help with third party agent compensation claims.
10.1.2 Failure to provide evidence that is collaborated by the delivering employee or The Companies third party agent that The Goods where damaged will result in The Buyer accepting solely responsible for The Goods and is to fully indemnify The Company and its employee(s) (or its third party agents) in respect of any loss therefor
11. Returns and Refunds
11.1 Returns must be made within 7 working days of the original delivery date.
11.2 Notification of a return must be sent to The Company by email, including any order numbers and/or identifying references.
11.2.1 Delivery costs will not be refunded.
11.3 Returns will only be considered is The Goods are in resaleable condition.
11.3.1 At The Company discretion, it reserves the right to refuse to accept the goods if it considers The Goods to be non-saleable. The Companies decision is final.
11.4 A restocking charge of 25% will be levied against all Metal roll purchases inclusive of Lead, Copper and Stainless Steel [including Lead, copper and stainless steel rolls, lead expansion joints and slates].
11.5 A restocking charge of 15% will be levied against all other ancillary products.
11.6 If The Buyer requests that palletised metal orders be collected, a collection cost of £120 collection will be charged and/or deducted from any refund.
11.7 Returns must be returned to: Abbey Metals Trading Ltd, Unit 9 Armstrong Way, Southall, Ealing, UB2 4SD
11.7.1 Special order items will not be accepted for returned and will not be refunded.
Any products that have been installed, attempted to be installed will not be considered for return or refund.
