Lead Guarantee

1.            Introduction

Abbey Metals Trading Ltd is the UK trading arm of ABY S.A [trading as Abbey Metals Europe]; a family run business that has manufactured lead metal products for more than 60 years.

Abbey Metals Europe is a manufacture of lead metal to BS EN 12588:2006, ‘Lead and Lead Alloys - Rolled Lead Sheet for Building Purposes.’ Historically, an influencing member of the European Lead Sheet Industry Association (ELSIA) now known as the International Lead Association (ILA).

It is Abbey Metals Europe’s investment in technologies, its consequential consistencies with which we derive longevity, and confidence in our manufacturing processes that allow us to offer a free of charge, 50-year guarantee with every purchase of Rolled Sheet Lead products manufactured to BSEN 12588:2006 when installed to British National Standards BS6915 and BS5534.

2.            Installation

The guarantee is valid when the Rolled Lead Sheet is correctly installed in strict
accordance with:

·         Metric British Standard, BS 6915:2001+A1:2014. ‘Design and Construction of Fully
Supported Lead Sheet Roof and Wall Coverings – National Code of Practice.

·         Metric British Standard, BS 5534:2014+A2:2018. ‘Slating and tiling for pitched roofs and vertical cladding. Code of practice’

·         Metric European Standard DTU 40:46, ‘Standard Unified Technical Document’

Additionally, there has been no external effect on and/or interference to the lead product and that the lead has been exposed to normal weathering and natural and fair wear and tear.

4.            Cover

This guarantee covers the owner, that if the product ‘fails to meet the manufacturing standard as set out within BSEN12588:2006 or is acknowledged by Abbey Metals to be ‘defective’:

A.        Abbey Metals will (for the failing or defective proportion of the material supplied) at its discretion:

a. Reimburse to the ‘owner’, ‘up to’ the original retail purchase price of the lead sheet,

b. Supply new lead sheet as required to replace the defective lead ‘up to’ the
original retail price of the lead sheet supplied.

B.         The guarantee applies to the lead sheet only. It does not cover any other products, installation and associated costs, materials or substance used in conjunction with the fitting of the lead sheet. Neither does it cover any subsequent damage to the building and/or the buildings contents.

4.         Limitation of liability

a. Abbey Metals provides this guarantee free of charge, and as such, all recipients and claimants are deemed to agree to all limitations and exclusions of liability as fair and reasonable in all circumstances:

b. Abbey Metals total liability is limited to and shall in no circumstances exceed the original retail sale price of the lead sheet supplied.

c. Abbey Metals shall not be liable to any recipient thereof or any potential claimant arising out of or in connection with this guarantee for any loss of or damage to profit, revenue, savings, data, contract and loss of business; or any consequential loss or damage, in each case howsoever caused or arising.

d. Any lead replaced/removed from site will be the property of Abbey Metals for analysis.

e. Disposal of this material will be at Abbey Metals’ discretion.

f. All claims arising or made in connection with this guarantee shall be governed by English law. Does not affect the purchaser’s statutory rights.

5.         Exclusions

When the installed lead elements:

·         have not been installed in line with national standards BS6915 and /or BS5534

·         have been affected by and/or contaminated by any other products or materials.

·         damaged by anything other than the fair wear and tear and natural causes.

·         have been maintained in any way that despite its original compliance, has rendered the installation non-compliant with the installation terms of this guarantee.

·         purchased from Abbey Metals more than 50 years before the claimant notification date.

·         Although some manufacturers approve fitting Lead Sheet onto geotextile underlays; we do not approve the use of these products and therefore, underside corrosion, specifically relating to the use of geotextiles will be treated as an exclusion and is not covered by our guarantee.

·         Brown staining relating to Nitrogen Oxide (NOx) is not covered.

Note: The stain, a brown/red mark on the surface of the sheet can appear at irregular intervals and without any noticeable or apparent cause. The reason for the staining is not entirely understood. There is a consensus that the stain may be caused, by NOx emissions from aviation fuel as staining has been found under flight paths. This theory is yet to be proven. No detrimental effect has been recorder to the performance of the lead sheet.
